Islamabad High Court Bars Deportation of Afghan Citizen

The Islamabad High Court directed the Ministry of States and Frontier Regions (SAFRON) to decide within one month on the petitioner’s request to cancel his POR card. Until then, the petitioner cannot be deported to Afghanistan.

Background

During the hearing, Justice Mohsin Akhtar Kayani remarked that civil courts cannot order the grant of citizenship, as this remains the government’s prerogative. The petitioner’s lawyer argued that, according to a Peshawar High Court ruling, NADRA must decide matters related to POR cards.

Parentage and Citizenship Claim

The court noted that the petitioner recently discovered his parents are Pakistani nationals. Therefore, he must first cancel his POR card before applying for citizenship.

Lawyer’s Position

The petitioner’s counsel stated that applications had already been submitted to SAFRON and NADRA, but no decision was made. The court ordered SAFRON to issue a decision within one month and adjourned the hearing.
