27th Amendment Debate: What Justice Kayani Said About the Ideology Council

ISLAMABAD: The Islamabad High Court on Tuesday heard arguments in a case linked to the 27th Constitutional Amendment, where Justice Mohsin Akhtar Kayani made notable observations about the evolving role of the Islamic Ideology Council (IIC).

Justice Kayani remarked that with the amendment in place, the Council’s powers could expand, allowing it to submit recommendations more frequently. However, he cautioned that once the amendment is fully implemented, certain powers currently exercised by the Council might no longer exist.

During the proceedings, the court asked representatives of the IIC whether the body is strictly advisory and who had formally sought its opinion in this matter. Justice Kayani emphasized that Parliament holds independent authority, and any judicial intervention could set a new precedent in the country.

The bench further questioned whether the Council is permitted to issue opinions beyond the legislature, the President, or provincial governors. Officials responded that the matter rests with the Council’s chairman, who has yet to be appointed. They confirmed that a recommendation for the appointment has been submitted and expressed hope that the position will be filled soon.

The petitioner had requested suspension of the Council’s opinion, but the court reserved its decision. It also noted that the Council had submitted an incomplete response, directing it to provide a comprehensive reply before the next hearing.

The case has now been adjourned until December 4, with the Supreme Court instructing the Islamic Ideology Council to clarify its jurisdiction before further proceedings.
