Karachi (Republic Pk) The Consumer Protection Court South ruled in favor of the consumer in the case of interruption, bad internet service and ordered the private company providing internet to pay Rs 50 thousand as damages and deposit Rs 5 thousand as fine to the government treasury.
According to the details, Judge Abdul Ahad Memon of Consumer Protection Court Karachi South gave a decision on the complaint. Petitioner Khaleeq Ahmed had stated that he has been using the internet service of the respondent company and has been paying the monthly bills regularly, however since January 7, 2022, the internet service remained continuous interruption, frequent disconnections and malfunctions, causing him serious problems in his professional and personal affairs.
According to record, the petitioner lodged several complaints but the problem was not effectively resolved. Later legal notices were also sent in response to which the company assured to replace the modem and restore the service, but the service problems persisted.
According to the judgment, the company had taken a stand in response to the legal notice that the service was restored on January 19, 2022, a response which proves that the internet service was affected for a significant period from January 7, 2022.
According to the court records, the petitioner submitted the paid bills, legal notices, company’s responses, details of complaints and other documentary evidence on record. On the other hand, the respondents neither filed a written reply nor challenged the evidence of the petitioner after the initial appearance.
The court stated that under the Sindh Consumer Protection Act 2014, failure, deficiency, non-standard performance or non-provision of facilities as promised falls under the category of service deficiency, although the petitioner claimed financial and professional loss, separate documentary evidence was not presented to prove the specific value of this loss, so the exact determination of financial loss is not possible.
